 TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the JM Designs 3D website, online store, products, custom-design services, and 3D-printing services.

Throughout these Terms, “JM Designs 3D,” “we,” “us,” and “our” refer to JM Designs 3D. “Customer,” “you,” and “your” refer to any person or organization accessing our store, placing an order, submitting a design, or purchasing our products or services.

By visiting our store, placing an order, submitting a file, approving a custom design, or purchasing a product, you agree to these Terms and our Shipping Policy, Return and Refund Policy, and Privacy Policy.

Please do not use our store or services if you do not agree to these Terms.

1. Eligibility and Lawful Use

You must be legally capable of entering into a binding agreement to purchase products or use our services.

You agree not to use our website, products, files, services, photographs, listings, or designs for any unlawful, fraudulent, abusive, or unauthorized purpose.

You may not interfere with the operation or security of our website, attempt to access restricted areas, introduce malicious software, collect customer information, or use automated systems to copy our product listings or website content.

 2. Products and Made-to-Order Manufacturing

Many JM Designs 3D products are made specifically for each individual order. Production may begin shortly after an order is placed.

Product photographs are representative examples. Because items are individually manufactured, the final product may not be identical to the item pictured.

Product measurements are approximate. Slight differences may occur because of design revisions, printer calibration, material behavior, finishing, assembly, and other normal manufacturing factors.

We reserve the right to:

* Limit the quantity of any product or order.
* Refuse or cancel an order.
* Discontinue or modify a product without notice.
* Correct pricing, description, availability, or typographical errors.
* Substitute an equivalent material when necessary, provided the substitution does not materially change the ordered product.
* Contact the customer when an order cannot be completed as submitted.

If we cancel an order before production because we cannot fulfill it, the amount paid for the canceled item will be refunded.

 3. 3D-Printing Characteristics and Manufacturing Tolerances

Customers acknowledge that fused-filament 3D printing is a layered manufacturing process.

Normal and acceptable characteristics may include:

* Visible layer lines.
* Small seams or starting points.
* Minor support marks.
* Slight surface texture.
* Small variations in shape or dimensions.
* Minor color variations between filament batches.
* Slight differences between computer renderings, listing photographs, and finished products.
* Small marks on the bottom or areas where the product contacted the printer’s build surface.
* Minor variations between two items produced from the same design.

These characteristics are not considered defects when they do not materially affect the product’s intended decorative or novelty use.

Computer monitors, phones, lighting, photography, and filament batches can display colors differently. We cannot guarantee that a product’s color will exactly match the color displayed on your screen or a previously purchased item.

 4. Customer Inspection and Defect Claims

Every product is visually inspected before shipment for significant defects, incomplete printing, major discoloration, broken components, and obvious manufacturing errors.

Customers must inspect their order promptly after delivery.

A claim involving a defective, damaged, incorrect, or missing item must be submitted within **10 calendar days of the carrier’s recorded delivery date**.

The claim must include:

* The customer’s name and order number.
* A description of the problem.
* Clear photographs of the item.
* Photographs of the shipping box and packaging when shipping damage is involved.
* Photographs showing all items received when an item is claimed to be missing.

We may request additional photographs or information before approving a claim.

Approved manufacturing-defect claims will generally be resolved by replacing the affected item within a reasonable production period. Depending on the circumstances and applicable law, we may instead provide another appropriate remedy.

Claims may be denied when:

* The claim is submitted after the 10-day reporting period.
* Required photographs or information are not provided.
* The condition is a normal characteristic of 3D printing.
* The product was damaged after delivery.
* The product was altered, painted, glued, heated, repaired, modified, or improperly stored.
* The product was used for a purpose for which it was not designed.
* The damage resulted from misuse, neglect, pets, children, weather exposure, excessive force, or improper handling.

This section must be read together with our Return and Refund Policy. Nothing in these Terms eliminates any consumer right that cannot legally be waived.

 5. No General Returns or Refunds

Because our products are made to order, customized, personalized, or produced specifically for the customer, we generally do not accept returns, exchanges, or change-of-mind cancellations.

Orders cannot normally be canceled after production, customization, file preparation, material preparation, or design work has begun.

Shipping charges, custom-design charges, setup charges, rush charges, file charges, and completed labor are nonrefundable except where required by law or expressly approved by JM Designs 3D.

6. Custom Orders and Personalization

Customers are responsible for reviewing all names, dates, spelling, colors, ship names, measurements, quantities, and other personalization details before submitting an order.

JM Designs 3D is not responsible for errors entered or approved by the customer.

When we provide a mockup, proof, photograph, written description, or design preview, the customer must carefully review it. Customer approval authorizes us to manufacture the item based on the approved version.

Changes requested after approval may:

* Require an additional design or setup charge.
* Delay production.
* Require the customer to purchase a replacement.
* Be refused if manufacturing has already begun.

Custom-design fees compensate JM Designs 3D for design time, setup, file preparation, revisions, testing, slicing, prototyping, and production planning. Payment for custom-design work does not automatically transfer ownership of the digital design file, source file, production file, or intellectual-property rights.

Any transfer of digital-file ownership or commercial rights must be stated in a separate written agreement signed or expressly approved in writing by JM Designs 3D. 

7. Customer-Submitted Files and Designs

When you submit a digital file, photograph, logo, name, design, model, drawing, text, trademark, character, or other material, you represent and warrant that:

1. You created and own the material or have obtained all necessary permissions and licenses.
2. JM Designs 3D is legally permitted to reproduce and manufacture the requested item.
3. The material does not infringe any copyright, trademark, patent, publicity right, privacy right, or other right belonging to another person or organization.
4. The requested product does not violate any law, regulation, court order, or contractual restriction.
5. The file does not contain malicious code or content intended to damage our systems.

The customer remains responsible for confirming ownership, licensing rights, and permitted commercial use. JM Designs 3D is not responsible for independently determining whether a customer-submitted file infringes a third party’s rights.

8. Limited License for Manufacturing

JM Designs 3D does not claim ownership of an original customer-submitted design solely because the customer submitted it for printing.

By submitting a file or design, you grant JM Designs 3D a limited, nonexclusive license to:

* Open and inspect the file.
* Copy and temporarily store the file.
* Repair or modify the file when reasonably necessary for manufacturing.
* Scale, orient, support, slice, convert, or process the file.
* Manufacture the requested quantity.
* Communicate with you about the file or order.
* Maintain temporary production or backup copies.

This license is limited to processing, producing, documenting, and fulfilling your order unless you separately authorize another use.

We may delete customer files after an order is completed. We do not guarantee permanent file storage and are not responsible for preserving the only copy of a customer’s file.

Customers should not submit confidential information, trade secrets, controlled technical information, or highly sensitive files without first entering into a separate written confidentiality agreement with JM Designs 3D.

9. Prohibited Designs and Products

JM Designs 3D reserves the right to refuse, cancel, or stop any project that we reasonably believe involves:

* Firearms, firearm components, ammunition, suppressors, or weapon-conversion devices.
* Weapons or items designed primarily to injure people or animals.
* Explosives or explosive components.
* Illegal drugs, drug-production equipment, or illegal controlled substances.
* Stolen intellectual property or unauthorized copies of protected products.
* Counterfeit merchandise.
* Obscene, exploitative, threatening, hateful, or unlawful material.
* Products intended to facilitate criminal activity.
* Regulated medical, aviation, automotive, electrical, or life-safety components.
* Any item that creates an unreasonable safety, legal, or reputational risk.

Refusal to accept a project does not constitute a legal determination about the customer or submitted material.

When a prohibited project is identified after work has started, the customer may remain responsible for completed design work, file preparation, materials, payment-processing costs, and other expenses already incurred, to the extent permitted by law.

10. JM Designs 3D Intellectual Property

Unless otherwise stated in writing, JM Designs 3D and its licensors retain all rights in:

* Original JM Designs 3D product designs.
* Digital design and production files.
* Custom files created by JM Designs 3D.
* Photographs, videos, graphics, logos, and artwork.
* Product descriptions and listing content.
* Website text and layout.
* Prototypes, revisions, and manufacturing methods.
* Branding, trade names, and promotional materials.

Purchasing a physical product does not transfer ownership of the underlying digital file or grant permission to reproduce, scan, mold, copy, manufacture, distribute, or sell the design.

No JM Designs 3D photograph, design, model, file, listing, logo, or written content may be copied or commercially used without prior written permission.

Products manufactured from designs licensed from third-party creators remain subject to the terms imposed by those creators and licensors.

11. Safety and Intended Use

Unless a listing expressly states otherwise, JM Designs 3D products are decorative, collectible, novelty, display, promotional, or recreational items.

They are not designed or certified for:

* Structural or load-bearing applications.
* Life-safety equipment.
* Automotive, aviation, marine, or industrial safety systems.
* Medical or dental use.
* Electrical safety components.
* Food preparation or food storage.
* Direct contact with open flames.
* High-temperature environments.
* Unsupervised use by small children.
* Use as flotation or water-safety equipment.

Many products contain small parts or articulated components that may create a choking hazard. Products should be kept away from babies, young children, and pets unless the product listing expressly states that the item is suitable for them.

3D-printed plastic may bend, soften, fade, crack, or deform when exposed to excessive heat, prolonged direct sunlight, hot vehicles, flames, chemicals, dishwashers, microwaves, or other unsuitable conditions.

The customer is responsible for evaluating whether a product is suitable for the customer’s intended use.

12. Functional Parts and Customer Specifications

JM Designs 3D does not guarantee that a customer-submitted model will function correctly, fit another product, withstand a particular load, or meet engineering requirements.

The customer is responsible for:

* Providing accurate measurements and specifications.
* Confirming tolerances, fit, clearance, and intended use.
* Testing prototypes before ordering larger quantities.
* Obtaining professional engineering advice when necessary.
* Confirming compliance with applicable codes, regulations, and safety standards.

Our acceptance of a file or order does not mean that we have evaluated or approved the design for safety, engineering performance, regulatory compliance, or fitness for a particular purpose.

13. Pricing, Payment, and Order Acceptance

Prices are displayed in U.S. dollars unless otherwise stated.

Applicable taxes, shipping charges, customization fees, rush fees, setup charges, design charges, and other costs may be added during checkout or invoicing.

An order confirmation does not guarantee final acceptance. We may contact the customer if:

* A product is unavailable or discontinued.
* A customization cannot be completed as requested.
* The selected size cannot accommodate the requested text.
* A price or listing error occurred.
* Additional design or production work is required.
* The order presents a legal, technical, or safety concern.

Customers authorize JM Designs 3D and its payment providers to charge the submitted payment method for all approved amounts.

Chargebacks filed without first making a reasonable attempt to resolve the concern directly with JM Designs 3D may be disputed using order records, communications, tracking information, production documentation, and delivery confirmation.

14. Shipping and Delivery

Production and delivery estimates are estimates and are not guaranteed unless JM Designs 3D expressly agrees otherwise in writing.

JM Designs 3D is not responsible for delays caused by shipping carriers, weather, natural disasters, labor disruptions, incorrect addresses, government actions, security inspections, holidays, service interruptions, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges resulting from an incorrect, incomplete, or undeliverable address may be charged to the customer.

When a carrier reports a shipment as delivered, the customer should check the delivery location, household members, neighbors, building management, mailroom, and local carrier office before reporting the package missing.

We may assist customers with carrier claims when appropriate, but carrier investigations and claim decisions are controlled by the carrier.

15. Third-Party Services

Our store may use or link to services operated by third parties, including payment processors, shipping carriers, social-media platforms, applications, and website-service providers.

JM Designs 3D does not control and is not responsible for the availability, security, policies, content, or performance of independent third-party services.

Your use of a third-party service may be governed by that provider’s own terms and privacy policy.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, and except for any written remedy expressly provided in these Terms or required by law, JM Designs 3D products and services are provided “as is” and “as available.”

JM Designs 3D disclaims warranties that may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

* Every product will be cosmetically perfect.
* A product will meet an unstated expectation or intended use.
* A customer-submitted design will function properly.
* A product will withstand heat, pressure, weight, impact, weather, chemicals, or prolonged outdoor exposure.
* Website access will be uninterrupted or error-free.
* Product colors will exactly match a screen display or previous filament batch.

Some states or jurisdictions do not allow certain warranty exclusions or limitations. In those locations, this section applies only to the extent permitted by law.

17. Limitation of Liability

To the fullest extent permitted by law, JM Designs 3D will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, business interruption, loss of data, personal projects, missed events, travel costs, or replacement purchases.

JM Designs 3D is not responsible for injuries, damage, or losses resulting from:

* Misuse of a product.
* Use in a structural, medical, electrical, automotive, aviation, marine, high-stress, load-bearing, or life-safety application.
* Heat exposure.
* Modification or alteration.
* Failure to supervise children or pets.
* Reliance on customer-supplied measurements or specifications.
* An illegal or infringing customer-submitted file.
* Failure to follow product warnings or care instructions.

To the fullest extent permitted by law, JM Designs 3D’s total liability arising from a product, order, or service will not exceed the amount the customer paid for the specific product or service giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

18. Customer Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless JM Designs 3D and its owners, employees, contractors, service providers, and representatives from claims, damages, expenses, liabilities, and reasonable legal fees arising from:

* Your breach of these Terms.
* Your unlawful use of our products or services.
* A customer-submitted file or design.
* A claim that customer-submitted content infringes another party’s rights.
* Your modification, resale, or misuse of a product.
* Your violation of any law or third-party right.

19. Intellectual-Property Complaints

JM Designs 3D respects valid intellectual-property rights.

A person who believes that material displayed or sold through our store infringes their rights should contact us and provide:

* Their full legal name and contact information.
* Identification of the protected work or property.
* Identification of the allegedly infringing product or content.
* The location of the product or content.
* Documentation supporting ownership or authority to act.
* A good-faith explanation of the complaint.
* A statement that the information submitted is accurate.

We may remove, suspend, or investigate disputed content while reviewing a complaint.

Submitting a false or misleading infringement complaint may expose the complaining party to legal responsibility.

20. Force Majeure

JM Designs 3D will not be responsible for a delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, fire, flooding, power outages, equipment failure, internet outages, supply shortages, carrier disruptions, labor disputes, illness, emergencies, government actions, war, civil unrest, or similar events.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of FLORIDA, without regard to conflict-of-law principles.

Before filing a formal legal claim, the customer agrees to contact JM Designs 3D and make a good-faith effort to resolve the dispute informally.

Unless applicable law requires otherwise, any legal proceeding relating to these Terms, an order, or our services must be brought in a court of competent jurisdiction located in Osceola County, Florida.

22. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

23. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

24. Changes to These Terms

We may update these Terms to reflect changes in our products, services, manufacturing practices, business operations, or legal obligations.

The effective date at the top of this policy will be updated when material changes are made.

The version in effect at the time an order is placed will generally govern that order unless applicable law requires otherwise.

25. Entire Agreement

These Terms, together with our product listings, order confirmations, approved custom-order details, Privacy Policy, Shipping Policy, and Return and Refund Policy, constitute the agreement between the customer and JM Designs 3D concerning the applicable purchase or service.

If a product listing or written custom-order agreement contains terms that specifically conflict with these general Terms, the more specific written terms will control for that order.
